The Immigration Section of the Minnesota State Bar Association
had a successful year of continuing legal education programs and meetings
on various topics of importance to its membership throughout the year.
We also worked in conjunction with the Minnesota/Dakota's Chapter of the
American Immigration Lawyer's Association in developing programs and participation.
Furthermore, the Section worked with local organizations on immigration
reform issues. The following is a summary of the programs sponsored in
the past year:

The Immigration Section of the Minnesota State Bar Association
had a successful year of continuing legal education programs and meetings
on various topics of importance to its membership throughout the year. We
also worked in conjunction with the Minnesota/Dakota's Chapter of the American
Immigration Lawyer's Association in developing programs and participation.
We met all of our principal goals of our CLE's, in that we had at least
one CLE on ethics, one on bias/diversity, and held one for students at the
University of St. Thomas Law School. In addition, we made a concerted effort
to have CLE's with other sections of the Bar Association, which included
the International Business Law Section, the Employment Law Section, the
Criminal Law Section and participated in the Annual CLE Conference of the
Family Law Section. One of the other highlights of the year was a half day
CLE Conference held with the Criminal Law Section in conjunction with the
American Bar Association Criminal Justice Section meeting in Minneapolis.
Hennepin County District Court Judge Catherine Anderson coordinated this
project which resulted in a successful conference. We look forward to planning
and hosting a similar set of programs in the coming year and intend to continue
our efforts in conjunction with other sections of the State Bar Association.

"The Roving Employee" Elizabeth Thompson will address
issues of H1-B and AC-21 portability: When is a new petition required? When
is a new LCA required? Who owns the Labor Certification? When should the employer
notify USCIS? What is same or similar occupation for portability?
"Marriage Under Removal Proceedings" Leo Pritschet will
address the issue of clients who are married, but under Removal Proceedings.
When is one eligible for a Matter of Garcia continuance? When does one need
a Matter of Velarde continuance? What variations are seen between local Immigration
Judges on Velarde continuances? What issues are arising on I-864, Affidavit
of Support eligibility? What does it take to prove the bona fides of a marriage
relationship?
"Immigration Consequences of Criminal Convictions" Dinesh
Shenoy will address common issues of crimes of moral turpitude, structuring
pleas, issues arising from DWIs, strategies for avoiding convictions for immigration
purposes, and the effects of criminal convictions of various types on the
immigration process.

1996-97 Annual Report
The Immigration Law Section held essentially four meetings during the course
of the year to discuss changes in immigration laws and policies. These meetings
included the following:
A meeting with Immigration Judge Robert D. Vinikoor regarding major changes
in immigration law contained in an act passed by Congress on September 26, 1996;
A meeting with Robert Esbrook, director of the I.N.S. Asylum Office in Chicago,
regarding the handling of asylum cases by that office;
A joint meeting with the Criminal Law Section regarding changes for criminal
offenders under the new Immigration Act of September 1996; and
A general update led by members of the section concerning critical changes
in immigration laws which took effect in September 1997.
The section also joined with the American Immigration Lawyers Association on
several other meetings with I.N.S. officials.
