At this "Lunch & Learn" seminar, attendees will learn:
- The Court's current view of the law of pre-emption in the context of FDA approved medical devices and pharmaceutical drugs.
- The Court will discuss its recent experiences and rulings as the MDL Judge in the Guidant litigation and its opinion in the Mensing decision, which eventually went to and was decided by, the U.S. Supreme Court.
- How pre-emption defenses differ when the case involves a manufacturer of a brand name drug, verses a manufacturer of a generic drug.
- Plaintiff’s strategies for defeating a pre-emption motion brought in a medical device case and a pharmaceutical drugs case.
- The status of pre-emption law in drug, device and food cases including how Bell Atlantic Corp. v. Twombly and Ashcroft v. Iqbal impacts pleadings to defeat pre-emption.
