"Force Majeure and Climate Change: What is the new normal?"
Force majeure provisions rely on courts to separate “normal” (non-compensable) weather events from “unusually severe” force majeure events. In an era of changing weather patterns, how will the force majeure provision be applied? This presentation describes current force majeure doctrine, analyzes the ways that changing weather will affect the analysis, and gives practical suggestions for reducing uncertainty in drafting force majeure clauses.
