"Cyberbullying: Sticks & Stones Will Break My Bones, But Can Electrons Cause Civil Liability?"
Where children’s taunts and threats have spilled from the playground into cyberspace, how is civil law catching up? Courts have applied old theories to this relatively new phenomenon, including theories of negligence, intentional infliction of emotional distress, and defamation. In addition, Congress and state legislatures have considered and passed bills seeking to address the issue. This presentation will provide caselaw, bills, statutes, and fact scenarios discussing the law’s adjustment to children who increasingly live online.

Damien Riehl, of Robins, Kaplan, Miller & Ciresi, L.L.P., practices in business litigation and intellectual property litigation — focused on software and other technology litigation. He began coding BASIC at 12 years old, has actively developed websites since 1994, and does not wear a pocket protector (regularly).
