The MSBA's ADR Section Presents

"ADR in Special Education: How to Build Trust in a Mediation System when Distrust Abounds"

Minnesota's Special Education Mediation Service (MNSEMS) provides services for parents and school district teams who disagree about a student's education plan. Through program evaluations, MNSEMS finds distrust and miscommunication contribute to the conflict and the request for mediation. The program coordinator explains how conflicts reach the state system and how case development and mediation preparation supports the role of the mediators who have assisted parties in resolving their conflicts in 91% of the cases last year.

Patricia McGinnis, Minnesota Department of Education
Patricia McGinnis holds a degree in education from the University of Minnesota and has over twenty years of teaching experience. She has been the Coordinator of Minnesota's Special Education Mediation Service since 2001, assuring access to the federally required mediation process and Minnesota's facilitated Individualized Education Program (IEP) meetings. In addition, Ms. McGinnis is a statewide trainer of leaders in special education on due process and facilitation of IEPs. She is a qualified neutral on the Minnesota Supreme Court Rule 114 Roster and mediates divorce and post-divorce conflict.
